1. Who we are and what this covers
These Terms govern your use of AZkont POS (“the Software”), provided by Azkont Solutions L.L.C., registered in the Republic of Kosovë under business number 812434968, with registered address Rr. Viliam Vokeri 41, Prizren (“we”, “us”). By accepting these Terms you enter into an agreement with us on behalf of the business that will use the Software (“you”). The person accepting confirms they are authorised to bind that business.
2. Licence
We grant you a non-exclusive, non-transferable, revocable licence to use the Software on the device on which it has been activated, for the duration of your subscription or licence term. The licence is granted per device. You may not sublicense, rent, resell, reverse-engineer, decompile or modify the Software, nor attempt to bypass its activation, integrity or fiscal controls.
3. Activation and device binding
The Software must be activated against our licensing service. Activation binds the licence to that device and provisions the fiscal identifiers and the device certificate. To do this the Software sends a device identifier derived from your hardware and an installation identifier. Moving the licence to another device requires a new activation.
3a. Licence status checks
The Software contacts our licensing service periodically to confirm that the licence is still valid. The check sends the device and installation identity, and no sales content. The licence verdict, that is the licence state and the service state, is cryptographically signed and verified on the device. The same answer also carries the business’s VAT status and, after an identity re-issue, the successor installation identifier; the Software uses these as information, not as the verdict. If the licence has expired, been suspended or been revoked under clause 11, the Software will act on that verdict. These checks are a condition of use and may not be blocked or circumvented.
4. Your responsibility for fiscalization
The Software is a certified Electronic Fiscal Software (SEF) intended to help you meet your obligations under Kosovë tax law. You remain solely and legally responsible as the taxpayer for issuing fiscal coupons, for the accuracy of the data you enter, and for complying with the Law on Tax Administration and Procedures, Administrative Instruction (MF) No. 01/2026 and any related ATK requirements. In particular you are responsible for: the accuracy of article names, prices, measuring units, VAT rates and tax categories you configure; restoring internet connectivity within the legally required period after an outage; using the special tax block correctly during a device failure; and retaining fiscal records for the period required by law. We are not responsible for penalties arising from your data, your configuration, or your failure to meet these obligations.
5. Certification and mandatory updates
The Software is certified by the ATK Commission. Certification depends on the Software remaining in conformity with the technical and functional specifications in force. You therefore agree to install compliance and security updates when they are made available. Updates are delivered through the Software itself: it checks our update service, downloads the package, verifies our cryptographic signature on it, and installs it. Updates that carry a compliance or security change are not optional. Continuing to use a version we have withdrawn may cause your fiscal coupons to be rejected, and may be a breach of your own legal obligations.
6. Accounts, PINs and operator identity
Each operator must have their own account and PIN. PINs must not be shared. Every fiscal coupon records the operator who issued it, and that record cannot be altered. You are responsible for all activity performed under accounts you create, for revoking access promptly when staff leave, and for keeping administrator credentials secure.
7. Data, backups and encryption
The Software stores your data locally in encrypted form and transmits fiscal data to ATK, and operational data to our back-office service, over secure connections. You are responsible for taking and safeguarding backups. BUSINESS PASSWORD: a single business password is chosen during the first till’s setup and typed on every till of the business. We never receive that password. Sales content, records and backups are sealed with a business key, which our back-office service holds only in sealed form. It is released only to a till of that business, after a one-time code sent to the business e-mail address held in the panel, so that a forgotten password can be reset without losing the data. Every release is recorded and you are notified by e-mail. Keep the business e-mail address correct and reachable, and keep the business password somewhere safe. On an ATK inspection request AZkont produces a sealed inspection file for the device (audit records, ATK transmissions and sales, exactly as the till exports them) that opens only with the ATK inspection password, also for tills that no longer exist; every generated file is recorded.
7a. Aggregated and anonymised data
We may create aggregated and anonymised statistics from usage of the Software and use them to operate, secure and improve our products. Such data is irreversibly stripped of anything identifying you, your business, your staff or your customers, and cannot be traced back to you. We do not disclose your identifiable business or transaction data to other clients or to third parties, except where required by law or as described in the Privacy Notice.
7b. Integrity monitoring
The Software continuously verifies the integrity of its fiscal records using per-record hashes and a hash chain. If that verification fails, the Software automatically reports the event to us, together with the installation identifier, the time of detection and a technical description. It does not send your transaction contents. This mechanism exists because the law requires fiscal records to be tamper-evident, and because we must be able to demonstrate that the certified Software detects tampering. You may not disable it. A confirmed tamper event may lead to action under clause 11 and, where the law requires it, to notification of the competent authority.
7c. Transfer between devices
Where you use the catalogue-transfer feature to move article data from one of your tills to another, the data is sealed in two layers: with the one-time code the sending till gives you and with the business key. Both are needed to open the package, so it opens only on a till of that business. We hold only the sealed package.
7d. Sending the coupon by e-mail
The Software never sends e-mail itself. The “Send by e-mail” button opens your own mail program with the coupon attached; you type the recipient and you send it. No customer address is stored by the Software for this purpose and no coupon passes through us.
8. Availability and offline operation
The Software is designed to keep working without an internet connection, queuing fiscal coupons for transmission when connectivity returns. We do not warrant uninterrupted availability of the ATK service, of our back-office service, or of your own connectivity. Coupons issued offline are marked accordingly and remain your responsibility to transmit within the legal deadline.
9. Support
Support is available Monday to Friday, 09:00-16:00 (CET), excluding public holidays in the Republic of Kosovë, through the channels published in the Software (info@azkont.com, +383 49 600 830). A forgotten business password is reset by the business itself through the code sent to the business e-mail address (clause 7). Support does not include correcting fiscal records that are, by law, immutable. On an ATK inspection request AZkont produces a sealed inspection file for the device (audit records, ATK transmissions and sales, exactly as the till exports them) that opens only with the ATK inspection password, also for tills that no longer exist; every generated file is recorded.
10. Fees and the Price List (Çmimorja)
Fees for the licence and any related services are set out in a separate document, the Çmimorja (Price List), which forms part of this agreement. We may revise the Çmimorja on the same basis as these Terms: we give you at least thirty (30) days’ advance notice, and your continued use of the Software after the effective date constitutes acceptance of the revised prices. If you do not accept a revised Çmimorja you must notify us by e-mail at info@azkont.com before the effective date, and clause 14 applies.
11. Suspension and termination
We may suspend or terminate the licence if: fees are unpaid; the Software is used in breach of these Terms or of applicable law; tampering with fiscal records, the integrity chain or the licensing mechanism is detected; or ATK withdraws or suspends the certification. Where the situation allows, we will give notice first. The Software contains a remote deactivation mechanism used to enforce this clause. On termination your locally stored fiscal data remains yours and remains subject to your statutory retention obligations.
12. Intellectual property
The Software, its source code, design and documentation remain our property. Your data remains yours.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of data. Our total aggregate liability is limited to the total fees payable by you under the Çmimorja in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
14. Changes to these Terms
We reserve the right to revise these Terms and the Privacy Notice. We will notify you in advance through the Software, at least thirty (30) days before the revised version takes effect. The notice states the effective date and where the revised text can be read. If you continue to use the Software on or after the effective date, you accept the revised version. If you do not accept it, you must notify us by e-mail at info@azkont.com before the effective date. In that case we may terminate your licence with effect from the effective date, and any fees you have prepaid for the period after termination will be refunded pro rata. You may equally choose to terminate at that date. The version and date of the Terms in force, and the date on which you accepted them, are always visible in Settings, About.
15. Governing law
These Terms are governed by the laws of the Republic of Kosovë. Disputes are subject to the jurisdiction of the competent courts of Prizren.
16. Language
These Terms are published in Albanian, English and Serbian. The Albanian version is the authoritative one; in the event of any discrepancy between versions, the Albanian text prevails.
